Wowcher E-Commerce Terms

This website ("Site") is operated by Wowcher Limited ("Wowcher", "we", "our" or "us"). We are registered in England and Wales under company number 4264984 and have our registered office at Wowcher Limited, Unit 1-2, 19A Fortess Grove, London, England, NW5 2HD. Our VAT number is GB 277 523 479.

Where we issue Vouchers on the Site, such transactions are governed by the Voucher Contract Terms and Conditions as set out below.

Where you buy a Choose Your Flight ("CYF") Holiday on our Site, we act as agent for the applicable Travel Provider and the Package Holiday Booking Conditions apply as set out below. For the avoidance of doubt, any other holidays on our site which are not "Choose Your Flight" or "CYF" will be governed by the Voucher Contract Terms and Conditions.

Voucher Contracts Terms and Conditions

These terms and conditions comprise 4 parts:

  • Part A - General Terms and Conditions, Issue of Vouchers and Redemption of Vouchers
  • Part B - Wowcher Own Deals
  • Part C - Package Holiday Booking Conditions
  • Part D - Voucher Validity Extensions
  • Part E - Terms and Conditions for Wowcher VIP

We issue multi-purpose vouchers. This means that you enter into a contract with Wowcher for the supply of a multi-purpose voucher. This voucher gives you flexibility to choose where to redeem it and, prior to the Expiry Date, you can choose to redeem your Voucher (a) for the deal that is listed in the Voucher (the "headline" deal); (b) towards any other deal on the Site; (c) for Wowcher Wallet Credit; or (d) in the Wowcher Shop at https://www.wowchershop.co.uk.

When you have decided how you wish to redeem your Voucher, you will need to actually "redeem" your Voucher with your chosen Merchant. When you redeem your Voucher, you are entering into a separate contract with the Merchant who will, in exchange for the Voucher, provide the Voucher Products (the "Merchant Contract"). Save for an Auto-Redeem Voucher (as defined below), please remember to redeem your Voucher as, unless you redeem your Voucher, we will not know which Merchant you want to redeem it with and so you will not receive any Voucher Products.

Vouchers are subject to their own terms and conditions as set out in the Fine Print. By placing an order through the Site, you warrant that you agree to and will abide by the Fine Print. In an event of a conflict between these E-Commerce Terms and the Fine Print, E-Commerce Terms will prevail.

Please read these terms and conditions carefully before ordering on the Site. You should understand that by placing an order on the Site, you agree to be bound by these terms and conditions.

Definitions

In these terms and conditions:

"Auto-Redeem Voucher" is a Voucher which will auto-redeem for the headline deal against which you purchased it after a certain time period. You can recognise an Auto-Redeem Voucher as the deal itself will make clear that the Voucher will auto-redeem and the Voucher will state auto-redeem and indicate the date at which it will auto-redeem.

"Deal Page" means the page on the Site which outlines a deal including details of the Merchant and the Voucher Products offered by such Merchant.

"Expiry Date" means the date specified on a Voucher after which the Voucher is no longer redeemable at (i) a particular Merchant or (ii) for another Voucher or (iii) as Wowcher Wallet Credit.

"Fine Print" means terms and conditions relating to the supply of the Voucher Products and redemption of the Vouchers as set out on the Deal Page under the headings "Fine Print" and "Full Details" including, but not limited to, the Merchant's Terms and Conditions.

"Merchant" means the seller of the goods and/or services.

"Merchant's Terms and Conditions" means terms and conditions issued by the Merchant in relation to the supply of Voucher Products.

"Protect My Voucher" is an optional add-on which allows you to extend the refundable period of a Voucher at the time of purchase.

"Returns Information" means the returns information slip included with your Voucher Products.

"Voucher" means a voucher which you may redeem (i) at a particular Merchant in exchange for Voucher Products offered by that Merchant; or (ii) for another deal; or (iii) as Wowcher Wallet Credit.

"Voucher Contract" means the contract formed between you and Wowcher when a voucher code is issued to you for redemption at a Merchant.

"Voucher Products" means the goods and/or services which are offered by a Merchant.

"Voucher Validity Extension" is an optional add-on which allows you to extend the validity period of an unredeemed Voucher.

"Wellbeing Deal" means a deal which states on the Deal Page that the Wowcher Wellbeing promise applies.

"Wowcher Own Deals" means the goods offered and supplied by Wowcher where we state on the deal "This deal is brought to you by Wowcher".

"Wowcher Gift Card" means a gift card issued by Wowcher which can be exchanged for Wowcher Wallet Credit.

"Wowcher Wallet" means a credit account for your use in connection with purchases on the Site.

"Wowcher Wallet Credit" means credit in a Wowcher Wallet.

Part A - General Terms and Conditions

1. Your Status

By placing an order through the Site, you warrant that:

  1. you are legally capable of entering into binding contracts;
  2. you are resident in the UK and are accessing the Site in the UK; and
  3. you are at least 18 years old.

2. Our Liability

2.1 Subject to clause 2.3 below, our liability for losses you suffer as a result of us breaking these terms and conditions is strictly limited to the purchase price of the Voucher.

2.2 Save in relation to Wowcher Own Deals, we are not responsible for the Voucher Products and/or any other goods and/or services for which a Voucher can be redeemed at a Merchant. The Merchant is solely liable to you for all Voucher Products and/or any goods and/or services which the Merchant provides to you. Before you redeem a voucher with a Merchant you should do your own research on the Merchant to make sure that you are happy with the Merchant and the products and services that you are redeeming your Voucher for. Buying products online from businesses that don't give a UK address increases the risk to consumers. In addition, please read the Deal Page and the Fine Print so that you are aware of all restrictions.

2.3 This clause 2 does not include or limit in any way our liability:

  1. for death or personal injury caused by our negligence;
  2. under section 2(3) of the Consumer Protection Act 1987;
  3. for fraud or fraudulent misrepresentation; or
  4. for any matter for which it would be illegal for us to exclude, or attempt to exclude, our liability.

2.4 Subject to clause 2.3, and to the maximum permissible extent under applicable law:

2.4.1 we will only be liable for foreseeable loss and damage caused by us. Loss or damage is foreseeable if either it is obvious that it will happen or if, at the time the applicable contract was made, both we and you knew it might happen; and

2.4.2 we will not be liable for losses that result from our failure to comply with these terms and conditions where such losses fall into one or more of the following categories even if such losses result from our deliberate breach:

  1. loss of income or revenue;
  2. loss of business;
  3. loss of profits;
  4. loss of anticipated savings;
  5. loss of data;
  6. waste of management or office time; or
  7. indirect, special or consequential loss.

2.5 Subject to clause 2.3, and to the maximum permissible extent under applicable law, we are not responsible or liable to you:
  1. for travel, accommodation and other costs and expenses incurred by you in attending the Merchant's premises and/or a reservation, appointment, even if such costs or expenses are wasted or unrecoverable as a result of the cancellation, rescheduling or alteration of a reservation, appointment or an event; and
  2. for any loss of enjoyment or amenity, including where an event has been cancelled, rescheduled or altered or delivery of a Voucher Product has been delayed; and
  3. for (i) any time taken off work by you to wait in for a delivery or attend a cancelled, rescheduled or altered reservation, appointment or event and (ii) any costs incurred by you (including but not limited to any costs relating to your "time" or "inconvenience") to liaise with us or a Merchant in relation to the Voucher Products; and
  4. if admission to a Merchant's premises is refused at any time as a result of your breach of any the Merchant's terms and conditions including but not limited to failure to adhere to their cancellation policies or dress codes and, in such cases, you will not be entitled to a refund.

3. Wowcher Wallet

3.1 The "Wowcher Wallet" is where any credit that you may have been awarded to use on Site will be found. There are three types of Wowcher Wallet Credit: (a) Redeemed Wowcher Wallet Credit which is Wowcher Wallet Credit that you have received when you have chosen to redeem you Voucher for Wowcher Wallet Credit in accordance with clause 8 or when you have redeemed a Wowcher Gift Card; (b) Promotional Wowcher Wallet Credit which is Wowcher Wallet Credit that has been given to you as part of a promotion, an incentive, a goodwill gesture or as a competition prize and which will usually have a short validity period; and (c) Refund Wowcher Wallet Credit which is Wowcher Wallet Credit that you receive when you have been refunded in Wowcher Wallet Credit.

3.2 You can see the current balance in your Wowcher Wallet and the historical balance by logging onto the Site and viewing the "My Account" pages.

3.3 Save for as set out in clause 3.4 below, credit in your Wowcher Wallet will expire (i) at midnight on the expiry date set out in either the Voucher or in the communication awarding you the credit or (ii) if no date is set out when you are awarded the credit, at midnight 3 months from the date of the communication to you awarding you the credit.

3.4 Where you have redeemed a Wowcher Gift Card for Wowcher Wallet Credit, your Wowcher Wallet Credit will expire 12 months after you have redeemed your Wowcher Gift Card.

3.5 If you receive credit to your Wowcher Wallet, the credit can be applied when you next purchase a Voucher on the Site save in relation to deals which set out in the Fine Print that highlight that Promotional Wowcher Wallet Credit cannot be used.

3.6 The maximum amount of Promotional Wowcher Wallet Credit that can be applied to an order is up to 10% of the price of each eligible product, with a £5 cap per eligible product.

3.7 If you cancel a Voucher Contract for a Voucher which you have bought using any Promotional Wowcher Wallet Credit you will forfeit any such Promotional Wowcher Wallet Credit and we will only refund you the amount paid for the Voucher in excess of any such Promotional Wowcher Wallet Credit.

4. How the Voucher Contract is Formed Between You and Us

4.1 The price of the Voucher Product(s) and your basket total will be as shown on the checkout page when you place your order. Payment via Visa, Mastercard, PayPal, Google Pay or Apple Pay for the basket total is required when you place your order. After placing an order for Voucher Products, you may receive a receipt from us or our payment processor confirming that we have received your order. Please note that receipt of this email does not mean that your order has been accepted even if we may have processed your payment as your order constitutes an offer to us to buy a Voucher. The contract between us ("Voucher Contract") will only be formed when we issue the Voucher to you. You should retain copies of the receipts for your records.

4.2 We reserve the right to change, modify, substitute, suspend or remove any information relating to a Voucher advertised on the Site at any time before a Voucher Contract is formed.

After Wowcher has issued a Voucher to you, you must choose how to redeem your Voucher.

5. Redeem a Voucher with a Merchant

5.1 Wowcher will issue the Voucher to you. The Voucher will set out the details of the headline deal (including the Merchant's details and the Voucher Products (i.e. the goods and/or services which will be offered by the Merchant of the headline deal)) and details of how to redeem the Voucher for the headline deal (i) at the Merchant or (ii) where the Merchant has asked us to process the redemptions on their behalf, how to redeem the Voucher on the Site. The Voucher will also set out how it can be redeemed for another voucher or for Wowcher Wallet Credit or in the Wowcher Shop. If the Voucher is an Auto-Redeem Voucher it will make clear when the Voucher will auto-redeem.

5.2 The Voucher is valid until the Expiry Date. After the Expiry Date the Voucher will be void and (i) the Merchant will not provide the Voucher Products; (ii) we will not accept a request to redeem for another voucher; (iii) we will not accept a claim to redeem the Voucher for Wowcher Wallet Credit; (iv) we will not accept a request to redeem the Voucher in the Wowcher Shop and (v) you will not be able to receive a refund for your Voucher.

5.3 When you redeem a Voucher with a Merchant you enter into a separate contract with the Merchant, the Merchant Contract. The Voucher Products are provided by the Merchant named on the Voucher in accordance with clause 5.1. The Merchant has a legal duty to supply the Voucher Products in conformity with the Fine Print. Please note that the Merchant is solely responsible for:

  1. providing the Voucher Products to you; and
  2. the Voucher Products
If you have any complaint in relation to the Voucher Products you should contact the Merchant directly.

5.4 Each Voucher is sold subject to the description on the Deal Page (including but not limited to the Fine Print) which sets out additional specific conditions related to that Voucher Product including, without limitation, terms and conditions concerning estimated delivery dates and times, availability and warranties (each as applicable). We will take reasonable care to check with the Merchant to ensure that all details, descriptions and prices of Voucher Products appearing on the Site are correct but please note that the details and descriptions are provided to us by the applicable Merchant and we cannot be held responsible for any inaccuracies. As we aim to keep the Site as up to date as possible, the information appearing on this Site at a particular time may not always reflect the position exactly at the moment you placed your Voucher Contract.

5.5 The images of the Voucher Products on the Site are for illustrative purposes only. Your Voucher Products may vary slightly from those images. In relation to goods, although we have made every effort to display the Voucher Products accurately, we cannot guarantee that a device's display of the colours accurately reflects the colour of the goods. The packaging of the goods may also vary from that shown in images on the Site.

5.6 Reproduction, sale, resale or trade of a Voucher is prohibited and we reserve the right to cancel any Voucher, at our discretion, if we believe that you have not complied with the provisions of this clause 5.6.

5.7 It is at the discretion of the Merchant whether a Voucher can be combined with any other vouchers, offers, promotions, coupons or gift certificates on redemption of the Voucher at the Merchant.

5.8 It is at the discretion of the Merchant whether to accept a Voucher for alternative goods and/or services to the Voucher Products provided that, where a Voucher is redeemed at a Merchant for alternative goods and/or services, there is no entitlement to a refund or a credit if such goods and/or services received have a value which is less than the Voucher's stated face value.

5.9 Except where expressly stated, Vouchers can only be redeemed in their entirety and may not be redeemed in part and/or instalments.

5.10 Neither we nor the Merchant are responsible for lost or stolen Vouchers.

5.11 To ensure you get the best service, if after you have redeemed your Voucher with a Merchant, the applicable Merchant informs us that they are no longer able to fulfil your order, we might share your information with an alternative Merchant who is able to provide you with the same or similar goods or services as the Voucher Products ("Alternative Voucher Products"). We will inform you if we are able to provide you with Alternative Voucher Products. If you do not wish to receive the Alternative Voucher Products, please respond to the communication advising you of the Alternative Voucher Products or contact us to let us know.

6. Redeem a Voucher Towards Another Voucher

6.1 After you purchase a Voucher, instead of redeeming it with the Merchant or for credit, you may redeem it towards the cost of another Voucher.

6.2 Save in relation to a Wellbeing Deal, if you redeem a Voucher towards the cost of another Voucher it will be of an amount equal to 100% of the purchase price of the original Voucher (inc. p&p but excluding any marketing/promotional credit) if the claim is made not more than 30 days after the date of issue of that Voucher, or 50% of the purchase price of the original Voucher (inc. p&p but excluding any marketing/promotional credit) if the claim is made more than 30 days after the date of issue of that Voucher but before the Expiry Date of the original Voucher.

6.3 For a Wellbeing Deal, if you redeem a Voucher towards the cost of another Voucher it will be of an amount equal to 100% of the purchase price of the original Voucher (inc. p&p but excluding any marketing/promotional credit) if the claim is made before the Expiry Date of the original Voucher.

6.4 The "Wowcher Wallet" is where any excess funds which results from the transaction will be found. Such funds will be valid for 3 months from the date of the communication to you awarding you the original Voucher.

7. Redeem a Voucher in the Wowcher Shop

7.1 After you purchase a Voucher, instead of redeeming it with the Merchant or for credit, you may redeem it towards the cost of goods in our shop at https://www.wowchershop.co.uk.

7.2 Save in relation to a Wellbeing Deal, if you redeem a Voucher towards goods in the shop it will be of an amount equal to 100% of the purchase price of the original Voucher (inc. p&p but excluding any marketing/promotional credit) if the shop purchase is made not more than 30 days after the date of issue of that Voucher, or 50% of the purchase price of the original Voucher (inc. p&p but excluding any marketing/promotional credit) if the shop purchase is made more than 30 days after the date of issue of that Voucher but before the Expiry Date of the original Voucher.

7.3 For a Wellbeing Deal, if you redeem a Voucher towards goods in the shop it will be of an amount equal to 100% of the purchase price of the original Voucher (inc. p&p but excluding any marketing/promotional credit) if the shop purchase is made before the Expiry Date of the original Voucher.

7.4 The "Wowcher Wallet" is where any excess funds which results from the transaction will be found. Such funds will be valid for 3 months from the date of the communication to you awarding you the original Voucher.

8. Redeem a Voucher as Wowcher Wallet Credit

8.1 After you purchase a Voucher, instead of redeeming it with the Merchant, you can redeem it for Wowcher Wallet Credit.

8.2 Save in relation to a Wellbeing Deal, the Voucher can be redeemed with us prior to the Expiry Date for a Wowcher Wallet Credit to the value of:

  1. 100% of the price paid for the Voucher where you redeem it upto 30 days after the date of its issue; or
  2. 50% of the price paid for the Voucher where you redeem it over 30 days after the date of its issue.

8.3 For a Wellbeing Deal, the Voucher can be redeemed with us prior to the Expiry Date for a Wowcher Wallet Credit to the value of 100% of the price paid for the Voucher where you redeem it upto 6 months after the date of its issue.

9. Cancellations and Refunds

Before you have redeemed your Voucher:

9.1 You may cancel a Voucher Contract without giving any reason within fourteen days from the day after the day you receive the Voucher provided that you have not already redeemed the Voucher (i) at a Merchant or (ii) as Wowcher Wallet Credit. If you cancel during this period, you will receive a full refund of the price paid for the Voucher.

9.2 To exercise the right to cancel a Voucher Contract, you must inform us of your decision to cancel the Voucher Contract by a clear statement using the below model cancellation form or you may Contact Us. You must destroy the Voucher and delete any emails sent to you with a copy of the Voucher. If you fail to comply with this obligation and/or attempt to use a cancelled Voucher, we may have a right of action against you for compensation.

9.3 You will not have any right to cancel a Voucher Contract where the Voucher has already been redeemed (i) at a Merchant or (ii) as Wowcher Wallet Credit or where the Voucher has passed its Expiry Date.

9.4 If you have cancelled the Voucher Contract in accordance with clause 9.2 above then we will refund the amount paid for the Voucher in full and any refund will be made within 14 days of a cancellation made in accordance with clause 9.2 by the same method originally used by you to pay for your purchase unless you have expressly agreed otherwise. In any event, you will not incur any fees as a result of the reimbursement.

After you have redeemed your Voucher:

9.5 Subject to clause 9.8 below, where the Voucher Products are goods, you have a legal right to change your mind and cancel your Merchant Contract at any time up to 14 days from the day after the day you receive the Voucher Products (unless you have ordered a bespoke product which has been custom made to their your requirements. Any bespoke products cannot be returned or refunded unless faulty). In this case, you will receive a full refund of the price paid for the Voucher Products including, subject to clause 9.6, any postage costs that you paid when placing your order. Any refund will be made within 14 days of receipt by us of the Voucher Products, or (if earlier) the day on which you supply evidence of having sent the Voucher Products back and by the same method originally used by you to pay for your Voucher Products unless you have expressly agreed otherwise. In any event, you will not incur any fees as a result of the reimbursement.

9.6 The maximum refund for postage costs will be the costs of postage by the least expensive delivery method that was offered. For example, if we offered delivery of goods within 5 days at one cost but you choose to have the goods delivered within 24 hours at a higher cost, then we will only refund what you would have paid for the cheaper delivery option.

9.7 To exercise the right to cancel a Merchant Contract in accordance with clause 9.5, you must inform the applicable Merchant of your decision to cancel the Voucher Contract by a clear statement or you may use the below model cancellation form or you may Contact Us. You must also return the Voucher Products to the address set out in the Returns Information included in your delivery, in the same condition in which you received them: you must send off the returned Voucher Products within 14 days of telling us you wish to end the Merchant Contract.

9.8 Returns are at your own cost and risk and the Merchant will not pay for any returns postage. You have a legal obligation to take reasonable care of any Voucher Products while they are in your possession. If you fail to comply with this obligation, the applicable Merchant may have a right of action against you for compensation. Where Voucher Products are not suitable for posting, the applicable Merchant will arrange for them to be collected and you will have to bear the direct cost for returning the Voucher Products. Whilst costs will be dependent on the item and the delivery provider used by the Merchant, the cost is estimated at approximately £15 for small to medium sized items and £45 for large items.

You will not have any right to cancel a Merchant Contract where the Voucher Products:

  1. have been used; or
  2. are audio or video recordings, video games or software and you have installed it or taken it out of the sealed packet in which it was delivered to you; or
  3. has been made or customized specifically for you; or
  4. are products sealed for health protection or hygiene purposes, once these have been unsealed after you receive them; or
  5. become mixed inseparably with other items after their delivery; or
  6. are by their nature of limited lifespan, such as flowers, fresh food and perishable goods; or
  7. are for a holiday which has been booked; or
  8. are for a ticket for an event on a named day.

10. Price and Delivery Charges

10.1 The price of any Voucher and any applicable delivery charge will be as quoted on the Site from time to time (inclusive of VAT (if applicable)), except in cases of obvious error as set out in clause 10.2 below. Unless expressly stated on the Site, delivery of Voucher Products will only be made to addresses in the United Kingdom mainland.

10.2 It is always possible that, despite our best efforts, some of the Vouchers listed on the Site may be incorrectly priced. We are under no obligation to issue any Voucher to you at the incorrect (lower) price. Furthermore, Merchants are not obliged to accept any issued Voucher nor are we obliged to honour a claim made for Wowcher Wallet Credit in respect of any issued Voucher if the pricing error was obvious and unmistakable and could have reasonably been recognised by you as a mispricing. In these instances, you will receive a full refund of the price paid for the Voucher.

10.3 For certain deals, we charge an administration fee. If an administration fee is charged, this will be indicated on the applicable Deal Page. Administration fees are calculated based on the total value of the order you are placing and not related to the price of a specific deal. Please see www.wowcher.co.uk/page/admin-fee.html.

11. Availability and Delivery

11.1 Your order will be fulfilled by the delivery timescale set out on the Deal Page or, if no delivery date is specified, then within 30 days of the date of the Merchant Contract, unless there are exceptional circumstances. Voucher Products will be at your risk from the time of delivery. This means that goods will be your responsibility from the time the Merchant delivers the Voucher Products to the address you gave when you formed your Merchant Contract.

11.2 If you have not received your Voucher Products by the estimated delivery date, please contact the Merchant as soon as possible. Please note that neither we or the Merchant are able to investigate any claims of non-delivery over 60 days after the date that you redeemed your Voucher with the applicable Merchant.

11.3 Unless otherwise stated on the Site, delivery of Voucher Products will only be made to addresses in the United Kingdom mainland.

11.4 In some cases, delivery will only be made to the billing address provided at checkout. If the delivery address and the billing address do not match in these cases, a Merchant Contract will not be formed and a refund of the price paid will be issued. The Fine Print will make it clear if this clause 2.2 applies.

11.5 For age restricted products, delivery will only be made once we have verified your age. If we do not receive your photo identification evidencing your age as requested, a Merchant Contract will not be formed and a refund of the price paid will be issued.

12. Faulty Goods

12.1 A Merchant is under a legal duty to supply goods that are in conformity with the Merchant Contract. If you discover a fault with any goods please let the Merchant know promptly.

12.2 A Merchant will normally offer a repair, exchange or refund of faulty goods. In all cases, we reserve the right to inspect the goods and verify the fault.

12.3 The Merchant will pay for the costs of returning any goods that are faulty.

12.5 If we are required to recall a Voucher Product, we will email the email address associated with the account that was used to purchase the Voucher. A list of all Voucher Products that we have recalled is available at https://www.wowcher.co.uk/page/productrecalls and we would recommend that you check this page regularly.

13. Risk

13.1 Voucher Products will be at your risk from the time of delivery.

14. Complaint Handling Policy

14.1 Once you have redeemed your voucher with a Merchant you will have a separate contract with the Merchant to supply the Voucher Products as outlined in clause 5.3 above. If you need help with your order or have a complaint about the Voucher Products, in the first instance your complaint should be addressed to the Merchant directly who should be able to answer any concerns that you may have.

14.2 If you have a complaint about Wowcher, how we operate, a Voucher that you have not yet redeemed or, where you have redeemed your voucher and have failed to reach a satisfactory conclusion with the Merchant in accordance with clause 6.1, you can contact us as follows:

15. Experience Gift Voucher

15.1 Experience Gift Voucher(s) can be purchased as a Gift Pack or an e-gift.

15.2 Experience Gift Vouchers must be gifted to a recipient ahead of redemption.

15.3 Recipient will receive a gift code in the form of (i) a code in an email if gifted an e-gift or (ii) a code in a physical pack if gifted a Gift Pack.

15.4 Once the code in the Experience Gift Voucher is redeemed by the recipient, gift credit is added to their account, matching the value of the Experience Gift Voucher.

15.5 Recipient can redeem gift credit against a range of experiences (subject to availability) listed on the Guide Page. Link for the Guide Page is included in the email the recipient receives upon redeeming the gift code.

15.7 The credit can be redeemed towards any deal included in the Guide Page provided that any additional cost is paid at checkout.

15.8 Experience Gift Voucher is valid for 6 months from the date of purchase, unless otherwise stated. After the expiry date (i) the voucher can no longer be gifted (ii) the voucher can no longer be redeemed by the recipient (iii) the credit credited to the recipient will be removed from the account (iv) the voucher is deemed as invalid.

15.9 Experience Gift Vouchers are non-refundable once redeemed.

16. Privacy Policy

16.1 When you place an order through the Site, you agree that we can use and process your personal information in accordance with our Privacy Policy.

17. Written Communications

17.1 Applicable laws require that some of the information or communications we send to you should be in writing. When using the Site, you accept that communication with us will be mainly electronic. We will contact you by e-mail or provide you with information by posting notices on the Site. For contractual purposes, you agree to this electronic means of communication and you acknowledge that all contracts, notices, information and other communications that we provide to you electronically comply with any legal requirement that such communications be in writing.

18 Events Outside Our Control

18.1 We will not be liable or responsible for any failure to perform, or delay in performance of, any of our obligations that is caused by events outside our reasonable control ("Force Majeure Event").

18.2 The Site relies in part on software to work. Software has bugs. Whilst we monitor the Site and try to fix bugs promptly, we do not guarantee that the Site will be error free, available all the time and/or free from viruses.

19. Waiver

19.1 If we fail, at any time to insist upon strict performance of any of your obligations or if we fail to exercise any of the rights or remedies to which we are entitled, this shall not constitute a waiver of such rights or remedies and shall not relieve you from compliance with such obligations.

19.2 A waiver by us of any default shall not constitute a waiver of any subsequent default.

19.3 No waiver shall be effective unless it is expressly stated to be a waiver and is communicated to you in writing.

20. Severability

20.1 If any provision of these terms and conditions or any Voucher Contract or any Wowcher Supply Contract is determined by any competent authority to be invalid, unlawful or unenforceable to any extent, such provision will to that extent be severed from the remaining terms and conditions or from the remaining provisions of any such contract which will continue to be valid to the fullest extent permitted by law.

21. Entire Agreement

21.1 These terms and conditions and any document expressly referred to in them represent the entire agreement between us and supersede any prior agreement, understanding or arrangement between us, whether oral or in writing.

22. Law and Jurisdiction

22.1 These terms and conditions are governed by English law. Any dispute arising from, or related to these terms and condition or any Voucher Contract or Wowcher Supply Contract shall be subject to the exclusive jurisdiction of the courts of England and Wales.

Part B - Wowcher Own Deals

This part only applies to Wowcher Own Deals.

Please note that we are the Merchant of Wowcher Own Deals. The Part A terms and conditions shall apply to the purchases of these deals save where stated otherwise below.

1. Our Liability

1.2. As the Merchant, we are responsible for the Voucher Products and/or any other goods and/or services for which a Voucher can be redeemed. Please read the Deal Page and the Fine Print so that you are aware of any restrictions applicable to the Voucher.

1.3 This clause 1 does not include or limit in any way our liability:

  1. for death or personal injury caused by our negligence;
  2. under section 2(3) of the Consumer Protection Act 1987;
  3. for fraud or fraudulent misrepresentation; or
  4. for any matter for which it would be illegal for us to exclude, or attempt to exclude, our liability.

1.4 Subject to clause 1.3, and to the maximum permissible extent under applicable law:

1.4.1 we will only be liable for foreseeable loss and damage caused by us. Loss or damage is foreseeable if either it is obvious that it will happen or if, at the time the applicable contract was made, both we and you knew it might happen; and

1.4.2 we will not be liable for losses that result from our failure to comply with these terms and conditions where such losses fall into one or more of the following categories even if such losses result from our deliberate breach:

  1. loss of income or revenue;
  2. loss of business;
  3. loss of profits;
  4. loss of anticipated savings;
  5. loss of data;
  6. waste of management or office time; or
  7. indirect, special or consequential loss.

1.5 Subject to clause 1.3, and to the maximum permissible extent under applicable law, we are not responsible or liable to you:

a. for any loss of enjoyment or amenity, including where delivery of a Voucher Product has been delayed; and b. for (i) any time taken off work by you to wait in for a delivery and (ii) any costs incurred by you (including but not limited to any costs relating to your "time" or "inconvenience") to liaise with us in relation the Voucher Products.
  1. for any loss of enjoyment or amenity, including where an event has been cancelled, rescheduled or altered or delivery of a Voucher Product has been delayed; and
  2. for (i) any time taken off work by you to wait in for a delivery or attend a cancelled, rescheduled or altered reservation, appointment or event and (ii) any costs incurred by you (including but not limited to any costs relating to your "time" or "inconvenience") to liaise with us or a Merchant in relation the Voucher Products; and

2. Redeem a Voucher with us

2.1 Wowcher will issue the Voucher to you. The Voucher will set out the details of the headline deal (including the Voucher Products) and details of how to redeem the Voucher for the headline deal on the Site. The Voucher will also set out how it can be redeemed for another voucher or for Wowcher Wallet Credit or in the Wowcher Shop. If the Voucher is an Auto-Redeem Voucher it will make clear when the Voucher will auto-redeem.

2.2 The Voucher is valid until the Expiry Date. After the Expiry Date the Voucher will be void and (i) we will not provide the Voucher Products; (ii) we will not accept a request to redeem for another voucher; (iii) we will not accept a claim to redeem the Voucher for Wowcher Wallet Credit; (iv) we will not accept a request to redeem the Voucher in the Wowcher Shop and (v) you will not be able to receive a refund for your Voucher.

2.3 We have a legal duty to supply the Voucher Products in conformity with the Fine Print. If you have any complaint in relation to the Voucher Products you should contact us at cs@dealhelp.co.uk.

2.4 Each Voucher is sold subject to the description on the Deal Page (including but not limited to the Fine Print) which sets out additional specific conditions related to that Voucher Product including, without limitation, terms and conditions concerning estimated delivery dates and times, availability and warranties (each as applicable). We will take reasonable care to check that all details, descriptions and prices of Voucher Products appearing on the Site are correct. As we aim to keep the Site as up to date as possible, the information appearing on this Site at a particular time may not always reflect the position exactly at the moment you placed your Voucher Contract.

2.5 The images of the Voucher Products on the Site are for illustrative purposes only. Your Voucher Products may vary slightly from those images. In relation to goods, although we have made every effort to display the Voucher Products accurately, we cannot guarantee that a device's display of the colours accurately reflects the colour of the goods. The packaging of the goods may also vary from that shown in images on the Site.

2.6 Reproduction, sale, resale or trade of a Voucher is prohibited and we reserve the right to cancel any Voucher, at our discretion, if we believe that you have not complied with the provisions of this clause 2.6.

2.7 It is at our discretion whether a Voucher can be combined with any other vouchers, offers, promotions, coupons or gift certificates on redemption of the Voucher.

2.8 It is at our discretion whether to accept a Voucher for alternative goods and/or services to the Voucher Products provided that, where a Voucher is redeemed for alternative goods and/or services, there is no entitlement to a refund or a credit if such goods and/or services received have a value which is less than the Voucher's stated face value.

2.9 Except where expressly stated, Vouchers can only be redeemed in their entirety and may not be redeemed in part and/or instalments.

2.10 We are not responsible for lost or stolen Vouchers.

3. Cancellations and Refunds

Before you have redeemed your Voucher:

3.1 You may cancel a Voucher Contract without giving any reason within fourteen days from the day after the day you receive the Voucher provided that you have not already redeemed the Voucher. If you cancel during this period, you will receive a full refund of the price paid for the Voucher.

3.2 To exercise the right to cancel a Voucher Contract, you must inform us of your decision to cancel the Voucher Contract by a clear statement using the below model cancellation form or you may Contact us. You must destroy the Voucher and delete any emails sent to you with a copy of the Voucher. If you fail to comply with this obligation and/or attempt to use a cancelled Voucher, we may have a right of action against you for compensation.

3.3 You will not have any right to cancel a Voucher Contract where the Voucher has already been redeemed or where the Voucher has passed its Expiry Date.

3.4 If you have cancelled the Voucher Contract in accordance with clause 9.2 above then we will refund the amount paid for the Voucher in full and any refund will be made within 14 days of a cancellation made in accordance with clause 9.2 by the same method originally used by you to pay for your purchase unless you have expressly agreed otherwise. In any event, you will not incur any fees as a result of the reimbursement.

After you have redeemed your Voucher:

3.5 Subject to clause 3.8 below, where the Voucher Products are goods, you have a legal right to change your mind at any time up to 14 days from the day after the day you receive the Voucher Products. In this case, you will receive a full refund of the price paid for the Voucher Products including, subject to clause 3.6, any postage costs that you paid when placing your order. Any refund will be made within 14 days of receipt by us of the Voucher Products, or (if earlier) the day on which you supply evidence of having sent the Voucher Products back and by the same method originally used by you to pay for your Voucher Products unless you have expressly agreed otherwise. In any event, you will not incur any fees as a result of the reimbursement.

3.6 The maximum refund for postage costs will be the costs of postage by the least expensive delivery method that was offered. For example, if we offered delivery of goods within 5 days at one cost but you choose to have the goods delivered within 24 hours at a higher cost, then we will only refund what you would have paid for the cheaper delivery option.

3.7 To exercise the right to cancel in accordance with clause 3.5, you must inform us of your decision to cancel the Voucher Contract by a clear statement or you may use the below model cancellation form or you may Contact us. You must also return the Voucher Products to the address set out in the Returns Information included in your delivery, in the same condition in which you received them and include the reason for requesting a refund along with the Wowcher code found on the Voucher: you must send off the returned Voucher Products within 14 days of requesting your refund.

3.8 Returns are at your own cost and risk and we will not pay for any returns postage. You have a legal obligation to take reasonable care of any Voucher Products while they are in your possession. If you fail to comply with this obligation, we have a right of action against you for compensation. Where Voucher Products are not suitable for posting, we will arrange for them to be collected and you will have to bear the direct cost for returning the Voucher Products. Whilst costs will be dependent on the item and the delivery provider used, the cost is estimated at approximately £15 for small to medium sized items and £45 for large items.

You will not have any right to cancel your contract, and will not be eligible for an exchange or refund (unless faulty or not as described) and Wowcher will not be liable for the cost of any returns where the Voucher Products:

  1. have been used; or
  2. have been opened or unsealed (other than where necessary to inspect); or
  3. are without original packaging or labels; or
  4. or the packaging of the Voucher Products, is in a poor condition; or
  5. are audio or video recordings, video games or software and you have installed it or taken it out of the sealed packet in which it was delivered to you; or
  6. has been made or customized specifically for you; or
  7. are products sealed for health protection or hygiene purposes, once these have been unsealed after you receive them; or
  8. become mixed inseparably with other items after their delivery; or
  9. are by their nature of limited lifespan, such as flowers, fresh food and perishable goods.

4. Availability and Delivery

4.1 Your order will be fulfilled by the delivery timescale set out on the Deal Page or, if no delivery date is specified, then within 30 days of the date you redeem your Voucher in return for a Voucher Product, unless there are exceptional circumstances. Voucher Products will be at your risk from the time of delivery. This means that goods will be your responsibility from the time we deliver the Voucher Products to the address you gave when you redeemed your voucher.

4.2 If you have not received your Voucher Products by the estimated delivery date, please contact us as soon as possible. Please note that we are not are able to investigate any claims of non-delivery over 60 days after the date that you redeemed your Voucher.

4.3 Unless otherwise stated on the Site, delivery of Voucher Products will only be made to addresses in the United Kingdom mainland.

4.4 In some cases, delivery will only be made to the billing address provided at checkout. If the delivery address and the billing address do not match in these cases, a refund of the price paid will be issued. The Fine Print will make it clear if this clause 2.2 applies.

4.5 For age restricted products, delivery will only be made once we have verified your age. If we do not receive your photo identification evidencing your age as requested, a refund of the price paid will be issued.

4.6 If we are unable to deliver your Voucher Product and it is therefore returned to sender, you will be refunded the value of your Voucher Product plus postage costs (in line with clause 3.6), however we are entitled to deduct the cost of fees incurred in returning your Voucher Product to sender from the value refunded.

5. Faulty Goods

5.1 If you discover a fault with any goods please let us know promptly. We will normally offer a repair, exchange or refund of faulty goods. In all cases, we reserve the right to inspect the goods and verify the fault.

5.2 We will pay for the costs of returning any goods that are faulty.

Part C - Package Holiday Booking Conditions

These booking conditions (the "Booking Conditions") set out the terms on which Wowcher makes available Choose Your Flight (CYF) "Package Holidays" for purchase on the Site or by any other means.

References to "Package Holidays" and "Package Organisers" in these Booking Conditions shall mean the same as how "Packages" and "Organisers" are defined in the Package Travel and Linked Travel Arrangements Regulations 2018 (the "PTR").

1. Your Relationship With Wowcher

1.1. We act as an agent for third party Package Organisers in the sale of Package Holidays on the Site. When you buy a Package Holiday through the Site, you will be entering into a contract for the supply of that Package Holiday with the Package Organiser. Our only role in the booking will be to arrange for you to enter into a contract with the Package Organiser. You will find the name of your Package Organiser in your order confirmation which is emailed to you by Wowcher ("Order Confirmation").

1.2. For the avoidance of doubt, Wowcher is not responsible for the provision, fulfilment or performance of the Package Holiday and will therefore not be liable to you for any failures in this regard. Our only obligation to you is to use reasonable skill and care in arranging for you to enter into a contract with the Package Organiser. The terms set out below describe the terms of the contract between you and the Package Organiser which, along with the Booking Confirmation (as defined in clause 2.2 below), will form the contract between you and the Package Organiser.

1.3. By booking a Package Holiday through us, you agree that:

  1. Wowcher's Website General Terms of Use (together, the "Terms") and these Booking Conditions will apply to your booking; and
  2. you are entering into a contract with the Package Organiser for the provision of the Package Holiday.

1.4. Please read the Terms as well as these Booking Conditions carefully before purchasing your Package Holiday through us. If there is anything within the Terms that you do not understand, the please contact us. If there is anything within these Booking Conditions that you do not understand, then please contact the Package Organiser using the details given in your Order Confirmation to discuss what this means for you. If you do not agree to the Terms or these Booking Conditions you must not book a Package Holiday through the Site.

2. Booking Your Package Holiday With The Package Organiser

2.1. All bookings for Package Holidays are subject to availability at the time of booking. We try hard to make sure that our advertisements are kept up to date, but we do not guarantee that any of the Package Holidays we advertise will still be available at the time of booking. We, or the Package Organisers, will inform you as soon as possible after you place a booking if, for any reason, the Package Holiday you have sought to book through the Site is not available.

2.2. A contract will only come into existence between you and the Package Organiser when you have paid the price payable on booking and a booking confirmation for the Package Holiday has been issued to you by the Package Organiser (the "Booking Confirmation"). The Package Organiser shall be under no obligation to issue a Booking Confirmation after you have placed a booking through the Site. The Package Organiser will not issue such a Booking Confirmation if we and/or the Package Organiser discover an error in the pricing of the Package Holiday (see paragraph 3 below) or if any part of the Package Holiday is no longer available.

2.3. If, for any reason, the Package Organiser is unable to accept your booking, it will inform you of this and not process your booking further. The Package Organiser will then arrange for you to be refunded any part of the Package Holiday already paid, unless you decide to use that payment towards a different booking.

2.4. If you have any special requests you must let the Package Organiser know during the booking process. We will attempt to pass on all reasonable requests to the Package Organisers at our sole discretion, but we cannot guarantee that such requests will be met by the Package Organisers.

2.5. If you have a medical condition or a member of your party is a person of reduced mobility, please let the Package Organiser know before making a booking so it can ensure that the Package Holiday is suitable for you.

2.6. The lead name on the booking will be the person responsible for the booking (the "Lead Passenger"). The Lead Passenger shall be responsible for paying the deposit and the full price, for making any amendment and cancellation requests, for paying any additional charges in relation to the booking and for all other matters concerning the booking. The Lead Passenger must be at least 18 years old at the time of booking.

2.7. The Lead Passenger must ensure and hereby confirms that the details provided for all parties to the booking are full and accurate, that all parties agree to be bound by these Booking Conditions and that the Lead Passenger has the authority to accept and does accept these Booking Conditions on behalf of all persons in the booking. The Lead Passenger agrees to check all descriptions on the travel documentation received after booking and to inform the Package Organiser immediately of any errors or instances where personal details do not correspond with those shown on the passports of those travelling under the booking.

3. Price of Package Holidays

3.1. We may change the advertised price of any Package Holiday from time to time. We try hard to make sure that the advertised price is the most up-to-date price, but prices can change at short notice. We, or the Package Organiser, will confirm the actual price at the time of booking.

3.2. We advertise a large number of Package Holidays on the Site on behalf of the Package Organisers and we try hard to ensure that the advertised price is always accurate, but sometimes errors do occur. The Package Organisers will normally verify prices at the time of booking. If there is a mistake, and the actual price is lower than that given at the time of booking, the Package Organiser will only charge you the lower amount. If the price is higher, the Package Organiser will contact you for instructions or reject your booking (at its sole discretion) and notify you of this so that you can decide what you would like to do.

3.3. The Package Organiser is under no obligation to supply you with a Package Holiday which is incorrectly priced, even after we or the Package Organiser has issued a Booking Confirmation, if the error should reasonably have been apparent to you. In these circumstances, we, or the Package Organiser, may contact you for instructions or cancel your booking and notify you so that you can decide what you would like to do.

3.4. The Package Organiser may change the price of your Package Holiday after it has issued its Booking Confirmation in order to pass on to you changes in: (i) the price of the carriage of passengers resulting from the cost of fuel or other power sources; (ii) the level of taxes or fees on the travel services included in your booking imposed by third parties other than the Package Organisers, including tourist taxes, landing taxes or embarkation or disembarkation fees at ports and airports; or (iii) the exchange rates relevant to the Package Holiday. The Package Organiser shall only be able to change the price in this way if it notifies you of any price increase at least 20 days before the start of your Package Holiday, together with a calculation and an explanation for this change.

3.5. If the price of your Package Holiday is increased by more than 8% of its total price, then you may:

  1. accept and pay for the price increase;
  2. reject the price increase and terminate your Package Holiday with a full refund; or
  3. reject the price increase, terminate your Package Holiday and take an alternative one if the Package Organiser decides to offer this. If you decide to take an alternative Package Holiday, the Package Organiser will inform you of its impact on the price of your booking. If the alternative Package Holiday is of a lower quality or cost, you may be entitled to a price reduction in accordance with paragraph 10 below.
The Package Organiser will give you a reasonable period of time to make your decision, which will usually be 7 days from notification of the price increase. If the Package Organiser does not hear from you within this timeframe, it will send a reminder to you, following which it shall be entitled to terminate the Package Holiday and provide you with a refund.

3.6. If you decide to reject the price increase and terminate your Package Holiday with a full refund, you may also be entitled to compensation in accordance with paragraph 10 below.

3.7. You will be entitled to a price reduction corresponding to any decrease in the costs described in paragraph 3.4 above which occur after you have booked but before the start of your Package Holiday, although the Package Organiser will be entitled to deduct its administrative expenses of this process. You will be entitled to ask for a breakdown of these administrative expenses.

4. Payment

4.1. When you make a booking with the Package Organiser for a Package Holiday and you select to pay a deposit, you must pay the percentage of the total booking price as indicated at the time of booking. The balance of the total cost of your booking must be paid in full by the timescale indicated at the time of booking. If either the deposit or the balance is not paid in full by the due date, the Package Organiser may cancel your booking immediately and, if you have already paid a deposit, the Package Organiser shall retain your deposit. In the event of such cancellation, the Package Organiser shall have no liability to you and the provisions of paragraph 8 below shall not apply. When you make a booking with the Package Organiser for a Package Holiday and a deposit option is not available or it is available but you choose not to select the deposit option, you must pay the total booking price at the time of booking. In addition to the total booking price, you will be required to pay an administration fee to Wowcher which is calculated in accordance with https://www.wowcher.co.uk/page/admin-fee.html.

4.2. In relation to ATOL protected flight-only sales or flight-inclusive Package Holidays, money accepted by Wowcher from you is held by Wowcher on behalf and for the benefit of the Trustees of the Air Travel Trust at all times, but subject to Wowcher's obligation to pay it to the Package Organiser for so long as the Package Organiser does not fail. If the Package Organiser does fail, any money held at that time by Wowcher, or is subsequently accepted from you by Wowcher, is and continues to be held by Wowcher on behalf of and for the benefit of the Trustees of the Air Travel Trust without any obligation to pay that money to the Package Organiser.

5. Alterations By You

5.1. If you wish to make a change to your booking after the Package Organiser has issued its Booking Confirmation, please contact the Package Organiser directly. The Package Organiser does not have a legal obligation to make such changes but it may, at its sole discretion, try to accommodate your request. Please understand that it is often not possible for the Package Organiser to do so as changes may depend on availability and the terms and conditions of the other Merchants of the services which make up your Package Holiday.

5.2. If the Package Organiser agrees to make a change, you agree to pay it an administration charge of £25 per person in making your required change plus any cost it incurs in making the change (including, without limitation, charges which are imposed on the Package Organiser by the Merchants of the travel services which make up your Package Holiday for making the change). This could be substantial and such costs tend to increase the closer to the departure date that the change is made. For instance, certain elements of the Package Holiday (e.g. a flight) may incur a 100% cancellation charge.

5.3. You may transfer your Package Holiday to another person who satisfies all the conditions applicable to the Package Holiday, subject to you and the other person accepting that you will both be liable, jointly and individually, for full payment of any balance due to be paid and any fees, charges or other costs arising from the transfer. The Package Organiser shall notify you of these costs upon receipt of your request to transfer. In order to take advantage of this possibility, you must contact the Package Organiser at the details set out in your Order Confirmation. You will need to give the Package Organiser reasonable notice of this change so that it can make the necessary arrangements, but 7 days before departure shall be considered to be reasonable.

6. Cancellations By You

6.1. You, or a member of your party, may cancel your booking at any time by giving the Package Organiser written notice by an email properly addressed to the email address set out in your Order Confirmation. Any such notice of cancellation must be given by the Lead Passenger on the booking.

6.2. As the Package Organiser may have incurred costs in relation to a cancelled booking (including, without limitation, charges which are imposed on the Package Organiser by the Merchants of the travel services), you will be charged a cancellation fee per person which reflects the losses and costs which the Package Organiser incurs in cancelling the booking. Please ask the Package Organiser if you would like to understand how these charges are calculated.

6.3. In addition to the cancellation right set out above, you shall have the right to cancel your booking before the start of the Package Holiday without paying any cancellation charge in the event of unavoidable and extraordinary circumstances (which is described in paragraph 11 below) ("Unavoidable and Extraordinary Circumstances") occurring at the place of destination or its immediate vicinity if the Package Organiser has confirmed to you that they will significantly affect the performance of the Package Holiday, or they significantly affect the carriage of passengers to the destination. If you cancel in this circumstance, the Package Organiser shall provide you will a full refund of any payments made in relation to your booking but you will not be entitled to compensation or any of the rights set out in paragraph 10 below.

6.4. The Package Organiser shall provide you with any refund of payments made under the booking, less any cancellation charges due to the Package Organiser, as soon as it can and in any event within 14 days of cancellation.

7. Amendments By The Package Organiser Before Departure

7.1. As the arrangements which make up your Package Holiday are planned many months in advance, from time to time the Package Organiser may need to make a change to your Package Holiday. The Package Organiser reserves the right to do so at any time. Most changes are minor changes, however, occasionally the Package Organiser has to notify customers of a significant change that it is constrained to make to the main characteristics of the Package Holiday, or where it cannot fulfil any of your special requirements which it has accepted.

7.2. In the unlikely event that the Package Organiser has to make a significant change to your Package Holiday, it will tell you as soon as reasonably possible. You will then have the option to:

  1. accept the proposed change. If this results in a Package Holiday of lower quality or cost, you may be entitled to a price reduction in accordance with paragraph 10 below;
  2. reject the proposed change and terminate your Package Holiday with a full refund; or
  3. reject the proposed change, terminate your Package Holiday and take an alternative one if the Package Organiser decides to offer this. If you decide to take an alternative Package Holiday, the Package Organiser will inform you of its impact on the price of your booking. If the alternative Package Holiday is of a lower quality or cost, you may be entitled to a price reduction in accordance with paragraph 10 below.
The Package Organiser will give you a reasonable period of time to make your decision, which will usually be 7 days from notification of the proposed change. If the Package Organiser does not hear from you within this timeframe, it will send a reminder to you, following which it shall be entitled to terminate the Package Holiday and provide you with a refund.

7.3. If you decide to reject the proposed change and terminate your Package Holiday with a full refund, you may also be entitled to compensation in accordance with paragraph 10 below.

7.4. The Package Organiser may not give you any of the above options in the event that a change to the purchased Package Holiday is a minor change. Please note that a change of flight time of less than 12 hours, a change of airline or aircraft (if originally identified), a change of departure or destination airport to one within the same region, or a change of accommodation to another of the same or higher standard usually qualify as minor changes.

8. Cancellations By The Package Organiser Before Departure

8.1. On rare occasions, the Package Organiser may have to cancel your Package Holiday and the Package Organiser reserves its right to do so. If the Package Organiser does have to do so, it will notify you as soon as possible. The Package Organiser will also offer you an alternative Package Holiday if it is able to do, and inform you of its impact on the price of your booking. If the alternative Package Holiday is of a lower quality or cost, you may be entitled to a price reduction in accordance with paragraph 10 below. If the Package Organiser cannot offer you an alternative, or even if you just prefer, it will provide you with a full refund of any payments made for the Package Holiday.

8.2. You may be entitled to compensation as a result of our cancellation of your Package Holiday in accordance with paragraph 10 below, except where the Package Organiser is prevented from providing the Package Holiday because of Unavoidable and Extraordinary Circumstances and the Package Organiser notifies you of the cancellation without undue delay before the start of your Package Holiday.

9. The Package Organiser's Responsibility For The Performance Of The Package

9.1. The Package Organiser does not itself necessarily own or provide any of the services, facilities or travel arrangements which make up your Package Holiday. These are often provided by third party Merchants whom the Package Organiser arranges to provide the services, facilities or travel arrangements which make up your Package Holiday. The Package Organiser has a legal duty to exercise reasonable skill and care in making the arrangements for the Package Organisers to provide the services, facilities and travel arrangements to you.

9.2. The Package Organiser also has a liability to you for the performance of the travel services included in your Package Holiday under the PTR, irrespective of the fact that such travel services are to be performed by the other Merchants.

9.3. You must tell the Package Organiser immediately of any failure to perform or improper performance of your Package Holiday ("Failure"). This will give the Package Organiser the opportunity to resolve the Failure whilst you are on your Holiday. If the Package Organiser refuses to do so, or if it is necessary to remedy the Failure immediately, then you may resolve the Failure yourself and request reimbursement of reasonable expenses from the Package Organiser. However, these rights will not arise if remedying the Failure is impossible or entails disproportionate costs. In that case, your only right will be to seek a price reduction or compensation in accordance with paragraph 10.

9.4. If a significant proportion of the travel services included in your Package Holiday cannot be provided as agreed in the booking, the Package Organiser shall offer, at no extra cost to you, suitable alternative arrangements for the continuation of the Package Holiday. The alternative arrangements shall, where possible, be of equivalent or higher quality than those specified in your booking. Where they are of lower quality you will be entitled to a price reduction as described in paragraph 10 below. You may only reject the alternative arrangements the Package Organiser offers to you if they are not comparable to what was agreed in the booking or if the price reduction is inadequate. If you do reject the alternative arrangements, or if the Package Organiser is not able to offer them, then you may, where appropriate, be entitled to a price reduction and/or compensation in accordance with paragraph 10.

9.5. If a Failure substantially affects the performance of the Package Holiday, and the Package Organiser has failed to remedy it within a reasonable period of time, you may decide to continue with your Package Holiday or terminate your booking without paying a termination fee. If you decide to terminate, then if your Package Holiday included carriage to the destination, the Package Organiser shall also repatriate you with equivalent transport without undue delay back to your place of departure and at no extra cost to you. You may, where appropriate, be entitled to a price reduction and/or compensation in accordance with paragraph 10.

9.6. If the Package Organiser is unable to ensure your return to your place of departure as agreed in your Package Holiday because of Unavoidable and Extraordinary Circumstances, it shall bear the cost of necessary accommodation, if possible of equivalent category, for a period not exceeding three nights per passenger. This limitation shall not apply to persons with reduced mobility and any person accompanying them, pregnant women and unaccompanied minors, as well as persons in need of specific medical assistance, provided that the Package Organiser was notified of their particular needs at least 48 hours before the start of the Package Holiday.

9.7. If a longer period of accommodation than that referred to in paragraph 9.6 above is provided for in Union passenger rights legislation (as described in the PTR) concerning your mode of return transport, or such legislation does not allow the transport provider to limit its obligations as described in paragraph 9.6 in the event of Unavoidable or Extraordinary Circumstances, then the limits set out in such legislation will apply instead.

10. Price Reduction And Compensation For Damages

10.1. You will be entitled to an appropriate price reduction for any period during which there is a Failure, unless the Failure is attributable to you.

10.2. You shall be entitled to receive appropriate compensation from the Package Organiser for any damage you sustain as a result of a Failure except where the Failure is:

  1. attributable to you;
  2. attributable to a third party unconnected with the provision of the travel services included in the Package Holiday and is unforeseeable or unavoidable; or
  3. due to Unavoidable and Extraordinary Circumstances.

10.3. The Package Organiser shall not be liable to pay compensation to you in connection with your Package Holiday where there are international conventions which limit the extent or the conditions under which compensation would have to be paid by one of Merchants of the travel services. These same limitations will apply to the Package Organiser and in an identical manner as if such limitations applied directly to the Package Organiser. These international conventions include (but are not limited to) the Montreal Convention in respect of travel by air (and all earlier related conventions), the Athens Convention in respect of travel by sea, the Berne Convention in respect of travel by rail (Convention concerning International Carriage by Rail (COTIF) of 9 May 1980), the Geneva Convention in respect of travel by road and the Paris Convention in respect of the provision of accommodation. The Package Organiser shall have the full benefit of any limitation of compensation which is contained in these conventions and any other international conventions which govern the travel arrangements which make up the Package Holiday. Please ask the Package Organiser for copies of these international conventions if you would like to see them.

10.4. The Package Organiser's liability will also be limited in accordance with the contractual terms of the relevant Merchants which provide the transportation element of your Package Holiday and in an identical manner as if such limitations applied directly to the Package Organiser.

10.5. The Package Organiser's liability to you in connection with your Package Holiday shall be limited to a maximum of three times the cost of your Package Holiday, except in cases involving death, injury or illness where the Package Organiser or its Merchants have caused such damage intentionally or with negligence.

10.6. If you are granted compensation or a price reduction by another party in relation to the same Failure which you claim compensation or a price reduction from the Package Organiser, then the Package Organiser may deduct the compensation or price reduction you receive from the other party from that which is payable by the Package Organiser.

10.7. Except as set out above, the Package Organiser will accept no liability for any claims, losses, expenses, damages or liability for your Package Holiday, except in cases involving death, injury or illness where the Package Organiser has caused such damage with negligence.

11. Unavoidable and Extraordinary Circumstances

11.1. In these Booking Conditions, where we refer to Unavoidable and Extraordinary Circumstances, it means a situation beyond the control of the party who invokes such a situation and the consequences of which could not have been avoided even if all reasonable measures had been taken.

11.2. This may cover for example warfare, other serious security problems such as terrorism, significant risks to human health such as the outbreak of a serious disease at the travel destination, or natural disasters such as floods, earthquakes or weather conditions which make it impossible to travel safely to the destination as agreed in the package travel contract.

12. Prompt Assistance In Resort

12.1. The Package Organiser shall provide you with appropriate assistance without undue delay if you are in difficulty, in particular by providing appropriate information on health services, local authorities and consular assistance; and by helping you make distance communications and helping you find alternative travel arrangements. Typically, the Package Organiser does not charge for this assistance, although it does reserve the right to charge a reasonable fee for such assistance if the difficulty has been caused intentionally by you or through your negligence.

12.2. If you are in difficulty and you need the Package Organiser's assistance, please contact the Package Organiser using the details set out in the Order Confirmation.

13. Excursions

13.1. It may be possible for you to book a local excursion during your Package Holiday, such as a local tour, experience, concert, activity, sports or adventure experience. These will be bookable and payable by you locally. You will be entering into a contract directly with the excursion provider and so they will not form a part of your Package Holiday. They will be provided by third parties over whom we, nor the Package Organiser have no control or relationship with. We and the Package Organiser do not have any responsibility for their provision. We and the Package Organiser do not accept any liability if you suffer loss or damage whilst on a local excursion.

13.2. It may also be possible for you to book an excursion as part of your Package Holiday at the time of booking. In that case, the excursion provider will be treated as a Merchant of a travel service which makes up your Package Holiday, and paragraph 13.1 above shall not apply.

14. Your Behaviour

14.1. It is important that you behave responsibly and with consideration for others during your Package Holiday. Accordingly, to the extent that the Package Organiser or one of its Merchants believes that your actions could or have caused disruption or annoyance, or a risk of safety, or damage to property, to the Package Organiser, the Merchant or other customers, or if it is believed that you are not fit to travel, then the Package Organiser may cancel your Package Holiday without further liability to you. In these circumstances, the provisions of paragraph 8 above shall not apply.

14.2. In the event that your behaviour causes loss or damage to any person or property for which the Package Organiser is liable, you agree to compensate the Package Organiser for such loss and damage, together with any legal costs which the Package Organiser may incur in pursuing this claim against you.

15. Your Financial Protection

15.1. The Package Organiser provides full financial protection for its flight-inclusive Package Holidays and ATOL protected flight only sales by way of its Air Travel Organiser's Licence number. Please see your receipt issued by Wowcher and your Booking Confirmation for details of the Package Organiser's ATOL number, which has been issued by the Civil Aviation Authority, Gatwick Airport South, West Sussex, RH6 0YR, UK, telephone +44 (0)333 103 6350, email claims@caa.co.uk.

15.2. When you buy an ATOL protected flight or flight inclusive Package Holiday from the Package Organiser you will receive an ATOL Certificate. This lists what is financially protected, where you can get information on what this means for you and who to contact if things go wrong.

15.3. The Package Organiser, or the Merchants identified on your ATOL Certificate, will provide you with the services listed on the ATOL Certificate (or a suitable alternative). In some cases, where neither the Package Organiser nor the Merchant are able to do so for reasons of insolvency, an alternative ATOL holder may provide you with the services you have bought or a suitable alternative (at no extra cost to you). You agree to accept that in those circumstances the alternative ATOL holder will perform those obligations and you agree to pay any money outstanding to be paid by you under your contract to that alternative ATOL holder. However, you also agree that in some cases it will not be possible to appoint an alternative ATOL holder, in which case you will be entitled to make a claim under the ATOL scheme (or your credit card issuer where applicable).

15.4. If the Package Organiser, or the Merchants identified on your ATOL certificate, are unable to provide the services listed (or a suitable alternative, through an alternative ATOL holder or otherwise) for reasons of insolvency, the Trustees of the Air Travel Trust may make a payment to (or confer a benefit on) you under the ATOL scheme. You agree that in return for such a payment or benefit you assign absolutely to those Trustees any claims which you have or may have arising out of or relating to the non-provision of the services, including any claim against the Package Organiser, the travel agent (or your credit card issuer where applicable). You also agree that any such claims may be reassigned to another body, if that other body has paid sums you have claimed under the ATOL scheme.

15.5. If applicable, see your Order Confirmation for details of how Package Holidays which do not include a flight, are protected.

16. Travel Information

16.1. Please note that the Package Organiser can provide general information about the passport and visa requirements for your trip, but your specific passport and visa requirements, and other immigration requirements are your responsibility and you should confirm these with the relevant embassies and/or consulates. Any information supplied by the Package Organiser on these or related matters (such as climate, when to travel, clothing, baggage, personal items etc.) is given as general guidance and in good faith but the Package Organiser does not accept liability for any decisions made on the basis of the information supplied.

16.2. The passport, visa and health requirements at the time of booking can be viewed on the Foreign and Commonwealth Office website (https://www.gov.uk/foreign-travel-advice). It is your responsibility to ensure that you and all members of your party are in possession of all necessary travel and health documents, and in compliance with any other immigration requirements, before you travel. If you or any member of your party is not a British Citizen or holds a non-British Passport, you must check passport and visa requirements with the embassy or consulate of the country(ies) you are travelling to or through. We, the Package Organiser, and the Merchants of the travel services do not accept any responsibility if you cannot travel because you have not complied with any passport, visa or immigration requirements. Please ensure that all your travel, passport, visa and insurance documents are in order and that you arrive in plenty of time for checking in at the airport. It may be necessary to reconfirm your flight with the airline prior to departure.

17. Insurance

17.1. It is important that you have sufficient insurance in place to cover you (and your group) whilst you are away. It is a condition of your booking with the Package Organiser that you have such suitable insurance cover in place. Please ensure that you have a valid travel insurance policy in place from the time of booking, to cover you for the countries and activities you may be undertaking on your holiday. You should contact the Package Organiser to discuss this if you do not already have insurance in place.

18. Flights

18.1. If the airline with which you are booked cancels your flight or ceases to trade whilst you are overseas, you must contact the Package Organiser for instructions on replacement flights. The Package Organiser's policy will be to try to replace a flight with an equivalent flight and so if your flight is economy, the Package Organiser will arrange an economy flight by way of replacement. You may pay the price of an upgrade if you so wish. If you had booked a higher class such as business, the Package Organiser will endeavour to find a business class seat by way of replacement, although if an economy seat is available on an earlier flight, the Package Organiser shall arrange for you to be booked on that earlier flight. This is because in the event that a flight is cancelled, the Package Organiser's main priority will be to find replacement flights to fly you home. It shall not be liable for any replacement flights you book if you have not first given it a reasonable opportunity to find replacement flights for you.

19. Resolving Disputes

19.1. If anything is not to your satisfaction during your holiday please immediately inform the Package Organiser (using the details set out in your Order Confirmation) or the relevant Merchant of the travel service (e.g. your hotelier) who will endeavour to resolve your problem. It is important you advise the Package Organiser as well as the Merchant so that they can both help to put things right without delay. We believe it is better for everyone to resolve problems that arise during your holiday promptly so that you can enjoy your holiday. However, if your complaint is not resolved locally, please follow this up within 28 days of your return home by emailing the Package Organiser using the details set out in your Order Confirmation, giving your booking reference and all other relevant information. Please keep your letter concise and to the point.

19.2. Please note failure to advise of problems whilst on holiday, as described above, deprives both the Package Organiser and the Merchant of the travel service of the opportunity to investigate and rectify your complaint whilst in resort and this may affect your rights under this contract including reducing any compensation due, potentially to zero.

20. ABTA

20.1. Some Package Organisers may be members of ABTA. Please check your Booking from the Package Organiser to find out if your Package Organiser is a member and its ABTA Membership number. If your Package Organiser is a Member of ABTA, it is obliged to maintain a high standard of service to you by ABTA's Code of Conduct. The Package Organiser can also offer you ABTA's scheme for the resolution of disputes which is approved by the Chartered Trading Standards Institute. If the Package Organiser cannot resolve your complaint, go to https://www.abta.com to use ABTA's simple procedure. Further information on the Code and ABTA's assistance in resolving disputes can be found on https://www.abta.com.

21. General Terms

21.1. The various paragraphs set out in these Booking Conditions operate separately to one another. If any court or any other relevant authority decides that any of these paragraphs (or part therein) are unlawful or unenforceable, the remaining paragraphs (and parts therein) will remain in full force and effect.

21.2. These Booking Conditions, the Terms and the associated Booking Confirmation set out the entire agreement between you, us and the Package Organiser. You are not relying upon any other statement, promise or assurance in relation to your booking.

21.3. These Booking Conditions are between you us and the Package Organiser. No other person shall have any rights to enforce any of their terms and conditions.

21.4. If we or the Package Organiser do not insist immediately that you do anything you are required to do under these Booking Conditions, or if we or the Package Organiser delay in taking steps against you in respect of your breaking this contract, that will not mean that you do not have to do those things and it will not prevent us or the Package Organiser taking steps against you at a later date. For example, if you miss a payment and we/the Package Organiser do not chase you immediately, we and the Package Organiser can still require you to make the payment at a later date.

21.5. We or the Package Organiser may transfer our rights and obligations with you under the Terms or these Booking Conditions to another organisation, and we will do our best to notify you if this happens, but this will not affect your rights or our obligations under the Booking Conditions.

21.6. These Booking Conditions and any dispute or claim (including non-contractual disputes or claims) arising out of them, their subject matter or formation shall be governed by and construed in accordance with the law of England and Wales.

21.7. You, we and the Package Organiser agree that the courts of England and Wales will have exclusive jurisdiction to resolve any dispute or claim (including non-contractual disputes or claims) arising out of or in connection with these Booking Conditions or their subject matter or formation.

21.8. If you have any queries about these Booking Conditions, please contact the Package Organiser using the details set out in the Order Confirmation.

Part D - Voucher Validity Extensions

This part only applies to Voucher Validity Extensions.

1. Purchase of Voucher Validity Extension

1.1. Voucher Validity Extension is only available for purchase on selected deals, as indicated to you on the Site.

1.2. Voucher Validity Extension is available for purchase up to 7 days before the Voucher Expiry Date.

1.3. When you purchase a Voucher Validity Extension for a Voucher, the original Expiry Date for that Voucher will be extended by up to 3 Months (subject to extension availability).

1.4. Once purchased, a Voucher Validity Extension cannot be transferred to another Voucher.

1.5. A Voucher can only be extended once.

2. Price

2.1. The price of any Voucher Validity Extension will be as quoted on the Site (inclusive of VAT (if applicable)).

2.2. The price of any Voucher Validity Extension is determined by a number of factors. We reserve the right to change the price, or the method by which the price is calculated, at any time.

2.3. The price of the Voucher Validity Extension will increase as a Voucher gets closer to its original Expiry Date.

2.4. Voucher Validity Extensions are non-refundable once purchased.

Part E - Terms and Conditions for Wowcher VIP

1. By signing up to Wowcher VIP membership, you are deemed to accept and be bound by these terms and conditions.

2. You agree that Wowcher may modify these terms and conditions at any time, in accordance with clause 13. You therefore agree

  1. to review these terms and conditions from time to time and
  2. that you are bound by any modified versions of the terms and conditions for the duration of your Wowcher VIP membership.

What is included within Wowcher VIP membership?

3. As a member of Wowcher VIP, you may be entitled to:

  1. Early access to our best deals
  2. Exclusive offers, discount codes and credit offerings
  3. Priority customer service on WhatsApp and Email

4. The features and services available to you through Wowcher VIP membership are subject to change. Wowcher reserves the right, in its reasonable discretion to substitute any feature or service offered with Wowcher VIP membership.

Wowcher VIP membership eligibility

5. Wowcher VIP membership is only available to UK residents, excluding employees and agents of (a) Wowcher or (b) any company connected with the production or distribution of Wowcher VIP membership, as well as their relatives or members of their family or household.

6. You must be aged 18 years or over at the date of your Wowcher VIP membership sign up. Proof of eligibility must be provided upon request.

7. If you are not already a subscriber to the Wowcher website, you will be required to create an account on the Wowcher website to create an account, email and credit card details are required. All correspondence regarding your Wowcher VIP membership shall be sent to the email address registered to your account.

8. Wowcher does not accept any responsibility for any Wowcher VIP membership sign up attempts which are not properly submitted, regardless of cause, including (for example) a result of any equipment failure, technical malfunction, systems, satellite, network, server, computer hardware or software failure of any kind. Wowcher will not accept proof of transmission as proof of membership.

9. Wowcher reserves the right to accept or refuse Wowcher VIP membership acting in its sole discretion.

What is the cost of Wowcher VIP membership?

10. By signing up to be a Wowcher VIP, you agree to a non-renewable Wowcher VIP membership for a period of up to 12 months; the number of months of membership will be displayed at the time of purchase. You agree to us charging you the one off Wowcher VIP membership fee to the card used to purchase Wowcher VIP membership at the point of checkout.

11. Your Wowcher VIP membership shall not be processed if the payment method used to sign up to Wowcher VIP membership is invalid.

12. Any vouchers, deals or other services purchased from Wowcher during your Wowcher VIP membership shall be charged separately and are not included within the cost of your Wowcher VIP membership.

Non-transferable

13.Wowcher VIP membership is not transferable and may not be re-sold. The services offered to you via your Wowcher VIP membership may not be transferred, shared, or assigned to any other person, and may only be used by the individual named on the account associated with the Wowcher VIP membership.

Termination of Wowcher VIP membership

14. By us - Wowcher reserves the right, in its sole discretion, to modify, suspend or cancel the Wowcher VIP membership offering at any time in any manner, in whole or in part acting in its sole discretion. In the event that it reasonably considers you to have acted in breach of these terms and conditions, in a manner that is detrimental to Wowcher, or in breach of the laws and regulations of England and Wales, Wowcher shall be entitled to terminate your Wowcher VIP membership and you shall not be entitled to a refund. Wowcher shall have no liability to you as a result of any such termination.

15. By you - You are entitled to cancel your Wowcher VIP membership without giving any reason within 14 days after the day you sign up to Wowcher VIP membership. If you cancel during this period, you will receive a full refund of the price paid for the Wowcher VIP membership only. Your refund will be made within 14 days of cancellation by the same method used to pay for your Wowcher VIP membership unless you have expressly agreed otherwise.

Part F - Protect My Voucher

This part only applies to Protect My Voucher.

1. Purchase of Protect My Voucher

1.1. Protect My Voucher is only available for purchase on selected deals, as indicated to you on the Site, at the time of initial purchase.

1.2. When you purchase Protect My Voucher for a Voucher, the refundable period for that Voucher will be extended until 7 Days before Voucher Expiry Date.

1.3. Unredeemed protected Vouchers can be self-refunded to original payment method via MyWowcher/MyVoucher page or refunded via usual customer service routes.

1.4. Once purchased, Protect My Voucher cannot be transferred to another Voucher.

2. Price

2.1. The price of any Protect My Voucher will be as quoted on the Site (inclusive of VAT).

2.2. We reserve the right to change the price of any Protect My Voucher, or the method by which the price is calculated, at any time.

2.3. Protect My Voucher is non-refundable once purchased.

Part G - Terms and Conditions for Wowcher Refer a Friend

This part only applies to Refer a Friend

This section set out the terms on which an eligible Wowcher account holder (the "Referrer") can invite a friend(s) (the "Friend") to make a Wowcher account in exchange for a reward.

1. How to Refer a Friend

1.1. Any Referrer who is eligible (by reference to clause 5) can refer a Friend to make a Wowcher account by sending the Friend a unique referral link.

1.2. A Referrer can send out up to 20 unique referral links for the lifetime of the account.

2. The Friend's Reward

2.1. When the Friend creates a Wowcher account using the unique referral link, £10 Wowcher Wallet Credit will automatically be added to the Friend's Wowcher Wallet.

2.2. To be a "Successful Referral" for the purposes of clause 3:

2.2.1. The Friend must purchase a Voucher; and

2.2.2. A period of 14 days must pass after the purchase of the Voucher during which no refund of the Voucher is made by the Friend.

3. The Referrer's Reward

3.1. The Referrer will be credited £10 into their Wowcher Wallet within 1 day of a Successful Referral.

4. The Credit

4.1. The credit earned through the referral programme is subject to change. Wowcher reserves the right, in its reasonable discretion, to substitute any feature or service offered as part of the referral programme.

4.2. Credit earned through the referral programme expires 30 days after being added to the Wowcher Wallet.

4.3. Please read Part A clause 3 for further terms governing the use of Wowcher Wallet Credit.

5. Wowcher Refer a Friend Eligibility

5.1. Wowcher Refer a Friend is only available to UK residents, excluding employees and agents of (a) Wowcher or (b) any company connected with the production or distribution of Wowcher Refer a Friend, as well as their relatives or members of their family or household.

5.2. You must be aged 18 years or over on the date of your Wowcher referral. Proof of eligibility must be provided upon request.

5.3. You will be required to create an account on the Wowcher website in order to refer a friend and/or be referred by a friend. To create an account and email are required. All correspondence regarding your referral shall be sent to the email address registered to your account.

5.4. You cannot refer a Friend who is already a Wowcher account holder.

5.5. You will not eligible for the credit where the Friend does not use the unique referral link provided.

5.6. You must not share unique referral links online via social media or review platforms.
